F.F.L. question, anybody?

I've been looking at a shotgun on Gun Broker, noticed seller wasn't F.F.L., just e-mailed seller, seller says gun doesn't have to be shipped by F.F.L., I always thought it had to be, F.F.L. to F.F.L., seller is in upstate N.Y., you say?

It's up to the receiving FFL if he will receive from a non-FFL shipper/seller.  If your FFL won't revive from a non-FFL, find an FFL that will, there are plenty of them out there.  It is not against the law for a non-FFL holder to ship a firearm to an FFL dealer for transfer.

The FFL process only regulates the purchase, not the sale, if that makes sense. Anyone who lawfully owns or possesses, may sell to another, and the FFL process regulates the purchaser, not the seller. 
 

As a non FFL seller, I get the purchaser’s preferred FFL, confirm they are legit (internet makes that easy) then ship accordingly depending on what’s being sold.  The receiving FFL then conducts the required checks and confirms the firearm is allowed to be lawfully possessed by the purchaser in their receiving jurisdiction. 
 

Totally on the level. Enjoy the GB mark up fees!  Try and buy local to avoid the GB tax, NJ state tax, and the NJ transfer fees. All said and done often makes a “deal” into a “steal” by the tax hungry State.

“didn’t know it was there”. That is what they always say when you question them on a flaw in a gun that they didn’t mention in the description of the gun. You can see it in a picture and they couldn’t see it being in possession of the gun?? Come on man! Not the kind of person you want to deal with. That is the problem with buying on the internet without seeing the gun in person. Unless you are dealing with a dealer you know has a good reputation it is always “buyer beware”. Good catch on your part.

Thanks, looked like just a crack in the butt plate, when pictured is expanded you could see a line going up the stock, seller said he was selling gun for a "friend" and wasn't aware of it., Have bought many guns from Gun broker, Guns international, Guns America, Gun Auction and Lion country supply throughout the years, always did o.k., but there's always a first time.
