9th Circuit Win!

Cannot understate how huge this is!!!

 

Absolutely shocked (in a good way) they put a blanket injunction on "sensitive places" and not just parts of it like they did in NJ and NY.

If the 9th circuit is issuing an order like this, then I suspect we'll do really well in the 3rd circuit, and would expect supplemental briefs for the plaintiffs in Koons/Siegel should be incoming very soon. 

This also potentially sets up a circuit split on "sensitive places" between 9th and 2nd circuits which makes it more likely SCOTUS will hear a "sensitive places" case.

Mark Smith (Four Boxes Diner) brought up a good point that the 9th Circuit Merits panel that reinstated the injunction could potentially sit on a ruling for a year or more after the hearing coming up in April. In which case California would have to suck it up and wouldn't be able to get an en banc hearing with the full 9th circuit until after the merits panel issues a final decision. They could try going to SCOTUS, but they know that won't help them either.

 

 

Hope Newsom, Murphy, and Hochul choked a little on their breakfast when getting this news!!

Again a huge win for 2A rights!!
