All species of snakes are protected by the Endangered and Nongame Species Act.  Basically, all species of snakes (all wildlife) are protected from being taken.  "Taken" has a very broad definition.  I am allowed to pick up the non-venomous species by hand and venomous species by stick (not tongs as tongs are not acceptable) via a number of State and Federal Permits I am issued annually and for which I had to jump thru a million hoops, some on fire, for.
