Tomorrow 11/19 will be 28 days since I went to Cabela's in Delaware to purchase a new rifle. The NICS check got a hold put on it and they (Cabelas) said it could take any where from one day to 30 days. Thursday will be 30 days. Has anyone ever had to wait this long? I live in NJ, could that be what's holding it up? Kind of at a loss as to why it's taking so long. Talked to Cabelas last week and they could only confirm that it was still showing as on hold. They said after 30 days, I would have to reapply for another NICS check or they would refund the gun purchase. They charged me for the gun back on the 19th because it was the last one and they said that's the only way they would be able to hold it for me while we waited for the NICS check to come back.

I believe there is a form you can fill out when you get put on hold or into research. With it being almost 30 days I would contact the state police firearms division and inquire what the hold up is and if there is anything you can do.

If you buy a long gun out of state, doesn't the NICS check go through the feds only? (or THAT state's NICS process, if they have one like NJ does?). I didn't think Delaware stores went through the NJ NICS process, so being from NJ shouldn't matter (But I don't know for sure).

Maybe Cabelas has an agreement with or is required by NJ (since they have a brick-n-mortar presence in NJ, the BassPro store in AC) such that they would go through NJ NICS for NJ residents regardless of where the purchase is (again, I don't know if that's true).

If you got an actual "Delay" response from NICS, according to the ATF website, that means they determined some record they found requires more research.   The feds have 3 business days to reply with a "Proceed" or "Denied" response. If Cabelas gets neither, it is up to their discretion to continue with the sale (unless Delaware law does not allow for it).

I've baught in pa cabelas.  It's 5 bucks and was out in 10 minutes.   So I don't think that's the case

Thanks - I have never been arrested. I do own an NJ business that requires state licensing so maybe that is what's causing the delay and this is the first time I've bought a gun since acquiring the business.

I am a NJ resident and have bought several guns at the Delaware Cabelas over the years and as recent last year. Delaware does not charge for the NICS check. Each time the check took 5 minutes or less.

I bought gun earlier this month at Bass Pro in Atlantic City had gun in 3 days, I’ve never bought gun from Bass Pro but is is a left hand Tikka 350 legend are made exclusively for Bass Pro/Cabelas, I’ve always bought from local shops paperwork took longer in store but wasn’t terrible paid for gun on a Tuesday evening and picked up on Friday

UPDATE: So the NICS expired and I decided to go down and redo it one more time. There were 3 other people there who had the same issue so I'm just chalking it up as they are just swamped with requests. After that, I got put in delay status again. 🤷🏻‍♂️

The guy behind the counter suggested getting a UIN. There is a spot on the forms for a UIN if you have one.

Interesting.. never heard of it.. looks like you have to go through a similar thing in NJ to get a FID, though (at least requires fingerprints, not sure if you get a background check, too)

I recently purchased my second long gun in PA at Dunkelberger’s in Broadheadsville. I filled out the NJ paperwork and the clerk entered my data into the NICS system. He told me I was “on hold”. His supervisor walked over, looked at the computer and showed his employee a minor mistake he made. I had my approval minutes later and left with the new rifle. BTW, no charge for the check. That must be a Cabela’s thing.

That's actually atrocious to wait 3 days.  But agree that 30 days is insane and won't surprise me if the person entering the form info messed up somewhere.  I did have to wait 3 days once, but it was early during Covid and massive delays were the norm for a short time.
