SCOTUS GVR'd 2A Cannabis case

Recommended Posts

Wasn’t there two cases in Jersey city where two cops lost their jobs because they wouldn’t stop smoking pot?  And  I thought one of them won he’s job back in court and is still smoking off duty and carrying a gun. Correct me if I’m wrong

It look's like Jersey City has a history of firing cops who smoke, The AG stated in 2022 Police Officers may smoke while off duty.

But as a Marijuana user they can not legally possess a gun.  So as usual nj picks and chooses wich laws it wants to follow and when.  I'm not saying I agree with it but the law is the law and smoking it makes one ineligible to own a fire arm on the federal level

Still illegal under federal law.  And on the fire arm form asks if you use Marijuana.   And gas a note that while states have legalized it remains illegal under federal law

You are assuming that the firearm they carry on duty is owned by them. Most agencies own the firearms that are issued and carried by the officers they employ.

Most likely your argument doesn't apply and is without merit.

Agree and I think it only applies to the purchase and not the ownership of weapons.

Let me start off by saying I don't smoke weed, and never have. No interest. But the fact that being a pot smoker makes you ineligible to own a firearm is ridiculous. How many raging alcoholics own guns? That's way more dangerous than some guy who just took a couple hits or threw back an edible or 2.

As ridiculous as it is.. Federal law  prohibits marijuana users from possessing Firearms or ammunition. Not just purchasing.

Federally Prohibited Persons (including marijuana users)

18 USC 922 (g) – Federally Prohibited Persons

The Federal Gun Control Act of 1968 and the Federal Omnibus Consolidated Appropriations Act of 1997 make it illegal for a person who fits into any of the following categories to ship, transport, receive or possess firearms or ammunition. These laws prevent a state from issuing a concealed carry license/permit as it would be illegal for people who fit in these categories, by federal law, to own or possess a gun.

Federal law prohibits the possession and purchase of fire Arms and ammunition by marijuanna users.  Again I don't agree with it but it's law. Again not saying I agree abd it will probably be rescheduled but as of this moment it remains illegal to use marijuanna and posess as per the gun control act.
