As Mark said it's not the greatest panel of judges for 2A, but I also agree with him that SCOTUS was pretty clear when they declined to intervene that they expect the 2nd circuit to use the Bruen standards or SCOTUS will  take it up.

I'm wondering what the impact will be on the NJ cases if the 2nd Appellate upholds the injunctions in NY. At that point Schmutter and Jensen can reference precedence that injunctions against laws nearly identical to NJ's have held under appeal. Then NJ has to take a long hard look at their chances of appeal in the 3rd circuit or even SCOTUS. 

IMO I think NJ and NY realize their "carry killer" laws are ultimately doomed and will appeal to some degree just to satisfy the anti-gun donors, but deep down neither of them want this in front of the current SCOTUS because they're liable to lose any ability to regulate guns (i.e. no fees, permits, AWB, mag bans, waiting periods, in-state NICS, sensitive places, etc...)
