Black Bear

The FW Council minutes the past few months have been mostly about re-writing the bear feeding laws so they can fine people who feed birds.  The courts found in favor of a homeowner and that FW can't enforce the bear feeding laws.

They haven't posted the May meeting minutes yet but the april minutes say...

"Director Golden wanted to inform council that Game Code amendments that we worked so hard on over the past several years were filed last week and they will appear in the May 5, 2021 NJ register. This will include some restrictions to help keep CWD out of NJ as well as separate the Black Bear Policy from the Game Code."

Who knows what that means?

That is what they already announced last year and got everyone in a tizzy. But as we discussed last year (I think it was in  October) the old bear management plan (which is what I think they are talking about here) expired and it just "polluted" the Game Code now because it expired so has no legal weight. So they are changing the Game Code to say something like "bear will be managed by the currently-in-place bear management plan" rather than have the Game Code contain the actual bear management plan itself. This way they don't have to keep removing and adding new plans every 5 years when new ones are put together.

This is why they want to remove it from the up-coming Game Code - no sense having the full bear management policy in the Game Code when it is expired at the time the new Game Code comes out. Just a waste of space at that point.

If the black bear management policy is passed and the new Regulations are compliant with the policy the link below has the 2021 dates and regulations.

Notice that the first section says...

"There may only be a season for black bears provided there is a valid comprehensive policy for the protection and propagation of black bear that has been approved by the Council and the Commissioner and adopted pursuant to the Administrative Procedure Act, N.J.S.A. 52:14B-1 et seq., rulemaking procedures, and the Council determines that this subchapter comports with such policy. In the absence of such policy, there shall be no season for black bears."

It’s a nice, clean way for the council and commissioner to comply with governor order/wish, which is not based on science, without actually doing anything. Politics win

I'm pretty sure but not positive that the FW Council passed a black bear management policy in January.  If so, it hasn't been signed by the DEP commissioner.  Maybe the commissioner wanted changes?  

I do know that the past few months the council meetings discuss a lot of crap about bird feeders and fining people who don't do some ridiculous things such as the height of the feeder, taking feeders in at night, cleaning up bird seed that is on the ground under the feeder and other stuoid crap they can use to fine people.

So that means we have to vote Lord Murphy out of office. 2026 ill be dead.
